Attorney general of india

Attorney general is the first law officer of the government of India. He was appointed by the President and holds office during the pleasure of the President. Conventionally, he resigns when the government (Council of Ministers) resigns or is replaced as he is appointed on its advice.


Qualification 
  • To be appointed as Attorney General of India, the person must be qualified enough to be appointed as the judge of Supreme Court.

Duties and Responsibilities 
  • His duties are to advice the government of India on legal matters or perform other legal duties which are referred to him by the President.
  • In performance of his legal duties, the Attorney General of India enjoys the 'Right of Audience' in any court of the country and is also entitled to take part in the proceedings of Parliament and Parliamentary Committees without the right to vote.

Term - not fixed by the Constitution, he holds the office during the pleasure of the President.

Remuneration - not fixed by the Constitution, it is determined by the President.


Attorney General of India represents union as well as state before the court and is also allowed to take a private practice provides he does not practice against the state/country.

He is not paid a salary but a retainer to be determined by the President and is equal to the salary of a Supreme Court judge and enjoys the privileges and immunities as reserved for Members of Parliament (MPs).

He is assisted by Solicitor Generals who are also assisted by Additional Solicitor Generals.

As per the convention, Attorney General of India resigns with the change of the Government and the new Government appoints their own Attorney General of India.

He is not a government servant nor a full time council of government. This office is regarded as 'Office of Profit'.
